Terms of Service

1. Service Description

DineAI provides an AI-powered phone receptionist service for restaurants. Our service answers incoming phone calls, takes orders, processes reservations, and integrates with restaurant POS systems. By using DineAI, you agree to these terms.

2. Subscription and Billing

  • Plans are billed monthly on the date of subscription
  • A per-minute usage fee applies for calls answered by the AI
  • A one-time setup fee is charged when your account is activated
  • All plans include an invite-only setup review. Billing starts only after your account is approved and activated
  • You may cancel at any time with 30 days notice
  • No refunds for partial months, but you retain access through the end of your billing period

3. Acceptable Use

You agree to use DineAI only for legitimate restaurant phone answering purposes. You may not:

  • Use the service for spam, harassment, or illegal activities
  • Attempt to reverse engineer or compromise the AI system
  • Share your account credentials with unauthorized parties
  • Misrepresent your restaurant or menu information
  • Use the service in a way that violates any applicable laws or regulations

4. Call Recording and Consent

DineAI records calls for quality, accuracy, and order verification purposes. You are responsible for complying with applicable call recording consent laws in your jurisdiction. Our AI includes an automated consent notification at the beginning of each call. Check your local and state regulations for specific requirements.

5. POS Integration

DineAI integrates with third-party POS systems (Square, Toast, Clover). You are responsible for maintaining an active account with your POS provider. DineAI is not responsible for POS system downtime, data sync delays caused by third-party issues, or changes to third-party APIs beyond our control.

6. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows are communicated in advance. Premium plan subscribers receive an SLA guarantee with specific uptime commitments and remediation terms.

7. Limitation of Liability

DineAI is not liable for lost orders, revenue, or business resulting from service interruptions, AI errors, or third-party failures. Our total liability is limited to the amount you paid in the preceding 12 months of service.

8. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, your AI phone number is released, call recordings are deleted per our retention policy, and any outstanding charges are settled. See our Privacy Policy for data deletion details.

9. Governing Law

These terms are governed by the laws of the State of Minnesota, United States. Any disputes shall be resolved in the courts of Hennepin County, Minnesota.
